Jarvis and Curry Secure Directed Verdict for Golf Course Developer Client

Keith Jarvis and Jill Curry were part of a trial team that secured a defense verdict for a golf course developer client.  The case involved claims by owners of 18 homes in Erie, Colorado. The homeowners claimed that after the golf course was built, water migrated from the golf course, causing soils to expand near their homes, and resulting in damage to their homes.  After Plaintiffs’ rested their, defense counsel moved for directed verdict.  The Court found that that Plaintiffs had not met their burden to establish the golf course developer was liable, and dismissed all claims against it before it had to put on any evidence at all. The Plaintiffs were seeking over $8,000,000.00 in damages.
